AI Governance and Responsible AI

AI governance should help a business decide which systems may be used, for what purpose, with which data and under whose supervision. A policy that does not change decisions is decoration.

THE WORK BEHIND THE DOCUMENT

Start with the decision and the facts.

I advise organizations adopting generative and predictive systems on the legal structure around selection, approval and ongoing use. The work connects vendor contracts, intellectual property, privacy, employment, consumer risk, human oversight and documentation. It can also include practical governance for the models themselves: who may configure them, which uses are prohibited, what testing is recorded and when a human must intervene.

I begin with the decision the system influences. A writing assistant, recruitment tool and customer-facing recommendation system do not create the same exposure. Controls should be proportionate, testable and assigned to real owners. Where a question depends on technical model performance, independent testing or foreign regulation, the legal scope is coordinated with the right specialist.

TYPICAL MATTERS

  • 01 AI use-case inventory, risk classification and approval pathways
  • 02 Vendor due diligence, procurement terms and model documentation review
  • 03 Rules for confidential data, personal data, prompts and generated outputs
  • 04 Human oversight, escalation, audit trails and incident handling
  • 05 IP, content, bias, employment and customer-facing risks
  • 06 Internal acceptable-use policies, training and governance committees

DELIVERABLES

Work product designed to be used.

Outputs may include an AI inventory, risk-rating method, use-case assessment, vendor checklist, contract redline, acceptable-use policy, approval record, human-oversight plan, incident process and governance roadmap.

SCOPE & BOUNDARIES

A defined role is part of good advice.

The engagement records the client, jurisdictional scope, deliverables, assumptions, timing and fee basis. Government and judicial fees, VAT, registrations, court representation, foreign-law opinions and third-party specialist work are excluded unless expressly included in writing.

Where another adviser is needed, I identify the question and coordinate the hand-off. General information on this page is not legal advice on a specific matter.

SERVICE FAQ

Questions specific to this work.

Do we need an AI policy if only a few employees use public tools?

Usually some rules are still needed because confidential information, personal data and work-product ownership can be exposed even in informal use.

Can you audit an AI model?

I assess legal governance and documentation. Technical testing of performance, security or bias may require data scientists or auditors.

Is governance meant to slow adoption?

No. A clear approval path can speed up low-risk uses while reserving deeper review for decisions with real legal or human impact.

NEXT STEP

Describe the decision, the parties and the real deadline.

I will review fit, conflicts and the information needed before proposing a scope. Do not send sensitive documents until an engagement and exchange method are confirmed.
